Terms of Service
Core terms for using GigNode Marketplace and GigNode Ops.

1. Service operator
GigNode is currently operated prior to the incorporation of its commercial entity. Corporate registration, registered address and jurisdiction details will be published here once incorporation is completed.

2. Accounts and use of the service
When you create an account, you agree to provide accurate, current information, protect your credentials, and take responsibility for activity under your account. GigNode provides GigNode Marketplace for creative-service discovery and proposals, and GigNode Ops as a delivery workspace for accepted work.
You may use the service only for lawful purposes for which you have authority. Features may change over time. GigNode will use reasonable efforts to operate the service but does not promise uninterrupted availability.
3. GigNode Ops and Marketplace
Marketplace helps clients create creative-service requests and receive structured proposals from reviewed providers. GigNode Ops provides project status, deliverables, feedback and revisions, approvals, activity history, and informational payment status.
GigNode is not an employer, agent, joint venturer, or professional adviser to either party. Provider review or publication does not guarantee identity, licensing, solvency, quality, or any outcome.
4. Provider and client relationship
The client and provider agree directly on scope, price, taxes, timing, intellectual property, and other commercial terms. An accepted proposal records the agreement between those parties; GigNode does not become a party to it.
Each party remains responsible for its own legal, tax, professional, and regulatory obligations.
5. Requests, proposals, and acceptance
Client requests must contain accurate, sufficient information that the client is entitled to share. Provider proposals may describe scope, deliverables, milestones, revision terms, timing, and commercial details. GigNode does not guarantee a match, a particular number of proposals, or that the parties will reach an agreement.
Both parties should review every term before a proposal is accepted. Product records do not replace professional or legal advice.
6. Deliverables, feedback, revisions, and approvals
Providers are responsible for deliverables they upload or link. Clients are responsible for feedback, revision requests, and approval decisions. Approval and status records make the workflow visible but do not by themselves prove compliance with a legal or industry standard.
Revision allowances, acceptance criteria, and the consequences of approval should be defined in the proposal or a separate agreement between the parties.
7. Payment visibility only
GigNode currently does not collect or process payments and does not provide escrow, payment protection, payouts, invoicing, or tax services. Amount, due-date, and status fields in Ops are informational tracking tools only.
Payments occur directly through a method chosen outside GigNode. The client and provider are responsible for payment disputes, refunds, taxes, and bank or payment-provider charges.
8. User-generated content
You or the relevant rights holder retain ownership of profiles, requests, proposals, files, links, portfolios, comments, and feedback. You grant GigNode a worldwide, non-exclusive licence limited to what is necessary to host, display, transmit, process, and operate that content through the service.
You represent that you have the rights and permissions needed to upload and share the content and that it does not violate privacy, intellectual-property, or other rights.
9. Acceptable use
- Do not submit unlawful, deceptive, harassing, or rights-infringing content.
- Do not introduce malware, attempt unauthorised access or security testing, automate abuse, send spam, or overload the service.
- Do not misrepresent your identity, authority, services, portfolio, or work outcomes.
- Do not upload confidential or personal data unless you are authorised to share it.
10. Suspension and termination
Access may be restricted, content hidden, or an account suspended for a breach, security risk, suspected fraud, legal requirement, or to protect other users. You may request closure through the available account-deletion flow; blockers such as active engagements or workspace ownership may need to be resolved first.
Termination does not remove payment duties, intellectual-property terms, liability limits, or dispute provisions that by their nature should continue.
11. GigNode intellectual property
The GigNode name, marks, software, interfaces, and original service content belong to their respective rights holders. These terms give you only a limited, revocable, non-transferable right to use the service.
12. Disclaimers and limitation of liability
To the extent permitted by applicable law, the service is provided “as is” and “as available.” GigNode does not warrant any provider, client, proposal, deliverable, commercial result, or uninterrupted access.
To the maximum extent permitted by law, GigNode will not be liable for indirect, incidental, special, punitive, or consequential loss, or loss of data, profit, goodwill, or opportunity. Liability that cannot lawfully be limited remains unaffected.
13. Governing law and disputes
These fields must be completed before launch using the verified company jurisdiction and legal advice.
